Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A lawsuit involving veterans' disabilities could be the answer for many veterans suffering from disabilities resulting from their military service. The Department of Veterans Affairs provides benefits to those who have served in the military, such as medical care and special programs.

According to a lawsuit filed Monday, Black veterans have disproportionately more difficulty obtaining these benefits. The suit was filed on behalf of Conley Monk Jr. by Yale Law School's Veterans Legal Services Clinic.

PTSD

PTSD symptoms can arise in people who have been traumatized. The symptoms include nightmares, anxiety or troubling flashbacks. The condition may cause people to avoid certain locations or situations that bring back memories of the traumatic event. This can cause a sense of isolation and depression. A new lawsuit jointly filed by Black veterans and the Yale law clinics has revealed that the Department of Veterans Affairs denied disability compensation claims of Black veterans consistently over the course of decades. Quil Lawrence of NPR reports that a VA whistleblower informed the veterans that VA documents revealed that Black veterans were denied benefits at a higher percentage than their white counterparts.

The lawsuit was brought by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. The lawsuit cites statistics showing that between 2001 between 2001 and 2020, the average rate for Black veterans of disability claims was rejected at 29.5 percent, compared to 24.2 percent of white veterans.

The lawsuit says that racial bias within the justice system of the military affected the discharge status of numerous Black service members and VA officials should have known this when they made decision-making regarding disability compensation. The lawsuit cites a study which found that between 2001 and 2020 the average denial rate for Black veterans who applied for disability compensation was 29.5 percent, compared with 24.2 percent for white veterans.
